The American legal system calls illegal entry into the United States a crime. But it is not a crime to hired undocumented migrants as they present two forms of documentation. One would be to establish the identity of applicant and the other that demonstrates the applicant has the right to work in the US. Penalties for employers’ noncompliance are less than $2,500 per violation. That’s pocket change for big companies.
Moreover, employers are not required to verify the documents’ authenticity. The employer must determine if the documents reasonably appear to be genuine and relate to the employee. If they do, the employer must accept them. Reasonably appear is a big loophole.
Should an employer discover that an employee is undocumented migrant, he or she has no legal requirement to report this fact to authorities.
